Whereas we always advise a pre-signature review of any contract, you should contact us for advice as soon as possible if you do not understand a term, feel bullied, or believe that the other party has not acted in terms of the contract.

Once the contract has been signed, the parties are bound by its terms. You may feel the urge to terminate a contract for time overruns or defective work, but termination of a contract has specific legal consequences and should not be done without proper legal assistance. Likewise, claiming damages, or initiating an insurance claim for defects are subject to definitive legal principles.

The commercial building industry is extremely volatile at the moment, with some builders over extending themselves, not performing in time, cutting corners, or simply going insolvent. You need someone to speak up for you, to protect and enforce your rights.

In certain instances, you are prohibited from instituting legal action until a tribunal has attempted to resolve the dispute. Non-compliance with these regulations will result in your matter being dismissed.
